The State Council of the Republic of Komi is a standing supreme and sole representative and legislative body of the Republic of Komi.
The State Council of the Republic of Komi includes thirty deputies elected by the RF citizens who are residents of the Republic of Komi and entitled to vote by secret ballot on the basis of the universal suffrage in accordance with the federal legislation.
The term of office of the State Council of the Republic of Komi is four years.
The State Council of the Republic of Komi is incorporated and has an official stamp.
Any citizen of the Russian Federation may be elected as a deputy of the State Council of the Republic of Komi. A candidate must be 21 years old or over and be eligible in accordance with the federal legislation, the Constitution of the Republic of Komi and the Law of the Republic of Komi.
The order of election to the State Council of the Republic of Komi is established by the Komi legislation in accordance with the legislation of the Russian Federation.
The State Council of the Republic of Komi decides the organizational, legal, information, logistical and financial provision issues independently.
The support costs for the State Council of the Republic of Komi are appropriated in the Komi budget as a separate entry.
Article 71, Constitution of the Republic of Komi
The State Council of the Republic of Komi will undertake its activities as sessions consisting of meetings as well as meetings of the committees and other bodies of the State Council.
The State Council will convene its first session on the fifteenth day since the polling day if the number of the elected deputies is not less than the two thirds of the set number of deputies. The oldest parliamentary hand will open the first session.
The session of the State Council of the Republic of Komi will be deemed eligible if, at least, the two thirds of the set deputies attend it. An eligible session of the State Council of the Republic of Komi will be held, at least, every three months.
The sessions of the State Council of the Republic of Komi are public except the cases established by the federal laws, the Komi legislation and the Parliamentary Rules of the State Council of the Republic of Komi.
The State Council of the Republic of Komi establishes committees and other bodies.
The deputies will elect the chairman, deputy chairman, chairmen of the committees and the other bodies.
The deputies of the State Council of the Republic of Komi may perform their functions on a permanent professional basis or without discontinuing their primary activities. The number of deputies working on a permanent professional basis is established by the Komi legislation.
The operating procedures of the State Council of the Republic of Komi, its bodies and officials will be established by the Parliamentary Rules of the State Council of the Republic of Komi and the activities of the bodies of the State Council may also be governed by their by-laws.
Article 72, Constitution of the Republic of Komi
The powers of the State Council of the Republic of Komi:
1) to adopt the Constitution of the Republic of Komi, amend and/or complement;
2) to exercise legislative control within the competence of the Republic of Komi and joint competence of the Russian Federation and its subjects in accordance with the competence of the Republic of Komi;
3) to exercise control on the Komi legislation enforcement and execution, performance of the republican budget and budgets of the regional state non-budget funds, keeping the established procedures on the property management in the Republic of Komi in cooperation with the other authorized bodies according to the Constitution and the laws of the Republic of Komi;
4) to exercise other powers in accordance with the Constitution of the Russian Federation, the federal laws, the Constitution and the laws of the Republic of Komi.
The Laws of the Republic of Komi:
1) establish the administrative-territorial system of the Republic of Komi and its changing procedures;
2) approve the budget of the Republic of Komi and its execution review to be submitted by the Head of the Republic of Komi;
3) approve the social and economic development programmes of the Republic of Komi;
4) establish taxes and dues reserved by the federal legislation for the competence of the Republic of Komi as well as their order of collection;
5) approve the budgets of the regional state non-budget funds of the Republic of Komi and their execution review;
6) establish procedures for state property management in the Republic of Komi in accordance with the Russian and the Komi legislation;
8) establish election and referendum procedures for the State Council of the Republic of Komi;
9) establish election procedures for local self-governance authorities in the Republic of Komi in accordance with the federal legislation;
91) dissolve municipal representative bodies in the event and order established by the federal legislation;
10) approve conclusion and repudiation of treaties of the Republic of Komi;
11) establish the structure of executive bodies of the Republic of Komi;
12) establish formation and operating procedures for the Control and Accounting Chamber of the Republic of Komi;
13) establish the state awards and titles of honour of the Republic of Komi;
14) regulate other issues reserved for the competence of the Republic of Komi in accordance with the RF Constitution, federal laws, the Constitution and the laws of the Republic of Komi.
The decrees of the State Council of the Republic of Komi:
1) to approve the Parliamentary Rules of the State Council of the Republic of Komi and address the internal regulations issues;
2) to effect the election of the Chairman of the State Council of the Republic of Komi, deputy chairmen, chairmen of the committees and other bodies and their deputies as well appointment of the chairman of the Control and Accounting Chamber of the Republic of Komi including his deputy chairmen or auditors;
21) to effect authorizing a citizen of the Russian Federation as the Head of the Republic of Komi upon recommendation of the RF President including the date of inauguration;
3) to make the judges of the Constitutional Court of the Republic of Komi;
4) to effect the election of the State Council representative in the Federation Council of the Federal Assembly of the Russian Federation including the issues of appointment of the representative of the Komi Government in the Federation Council of the Federal Assembly of the Russian Federation;
5) to make justices of the peace of the Republic of Komi;
6) to appoint a half of the members of the Electoral Committee of the Republic of Komi with the right to vote;
7) to appoint and dismiss a representative of the Human Rights Commissioner in the Republic of Komi;
8) to approve the proposals of the Head of the Republic of Komi on appointing his deputy heads of the Republic of Komi, minister of finance of the Republic of Komi, representatives of the Republic of Komi in the Russian Federation and its subjects, international organizations and foreign states;
9) to effect appointments in judicial and law enforcement bodies, the prosecutor of the Republic of Komi in accordance with the RF legislation;
10) to call a referendum in the Republic of Komi;
11) to fix a date for the State Council elections;12) to effect credit/discredit to the Head of the Republic of Komi, his deputy heads, minister of finance in accordance with the Russian and the Komi legislation;
13) to approve progress reports of the programmes for social and economic development of the Republic of Komi;
131) to effect the results of reviewing the information on the current situation in the Republic of Komi and a plan of action of the executive authorities for the prospective period submitted by the Head of the Republic of Komi;
14) to approve modifications in the border of the Republic of Komi;
15) to effect appeals to the Head of the Republic of Komi or executive bodies of the Republic of Komi on making changes and/or complementing the issued acts, their repeal or appeal in a judicial procedure;
16) to effect appeals of the State Council of the Republic of Komi to the State Duma of the Federal Assembly of the Russian Federation for initiation of bill;
17) to make a decision on taking a legal recourse at the RF Constitutional Court or the Constitutional Court of the Republic of Komi in accordance with the Russian and the Komi legislation;
18) to make decisions in parliamentary ethics;
19) to interpret the Komi legislation;
20) to effect enactment as well as enactment or defeat of bills;
21) to approve a draft agreement on delineation of powers;
22) to effect other resolutions on the issues of jurisdiction of the State Council of the Republic of Komi.
Article 73, Constitution of the Republic of Komi
The powers of the Chairman of the State Council of the Republic of Komi:
1) to have overall charge of the issues under consideration of the State Council;
2) to convene and chair the meetings of the State Council;
3) to sign resolutions passed by the State Council and orders of the Chairman of the State Council;
4) to exercise other powers related to the activity of the State Council.
The powers of the deputies to the Chairman of the State Council of the Republic of Komi:
1) to coordinate the work of the committees related to preview of the bills or other legal acts and the work of other bodies of the State Council;
2) to exercise other powers related to the activity of the State Council by order of the Chairman of the State Council.
Article 74, Constitution of the Republic of Komi.
The deputies, the committees and the Chairman of the State Council, the Head of the Republic of Komi, the Government of the Republic of Komi, the Constitutional Court of the Republic of Komi, the municipal representative bodies and the Interregional Social Movement "Komi Voytyr" have the right to initiate legislation. The Presidium, the standing or interim committees of the State Council have the right to initiate legislation within their authority.
The bills brought in by the Head of the Republic of Komi to the State Council will be considered at his suggestion as matters of priority.
The bills of the Republic of Komi will be considered by the State Council of the Republic of Komi not less than in two readings.
The bills on tax levy, abatement or exemption, changing the financial liabilities of the Republic of Komi or other bills that ensure expenses covered by the republican budget of the Republic of Komi will be considered by the State Council of the Republic of Komi as advised by the Head of the Republic of Komi or when his letter of opinion is available. This letter of opinion will be submitted to the State Council of the Republic of Komi within twenty days since the bill is received by the Head of the Republic of Komi.
Article 75, Constitution of the Republic of Komi.
The laws of the Republic of Komi will be passed by the State Council of the Republic of Komi at its sessions when voted affirmatively by the majority of the set number of deputies, if the legislation does not provide otherwise.
Other legal acts will be passed by the State Council of the Republic of Komi when voted affirmatively by the majority of the deputies elected, if the federal legislation does not provide otherwise.
Article 76, Constitution of the Republic of Komi.
The law passed by the State Council of the Republic of Komi will be submitted within ten days to the Head of the Republic of Komi for promulgation.
The Head of the Republic of Komi will make the law of the Republic of Komi public by attesting the promulgation by signing or reject the law within fourteen days since the date of entry of the said law. If the Head of the Republic of Komi rejects the law, it will be returned to the State Council of the Republic of Komi with reasoned substantiation of rejection or the proposal to amend and/or complement it.
In case the Head of the Republic of Komi rejects the law of the Republic of Komi, the State Council of the Republic of Komi can pass the law in statutory wording if the law is voted affirmatively by not less than two thirds of the votes of the set number of deputies.
The law of the Republic of Komi passed in statutory wording cannot be rejected repeatedly by the Head of the Republic of Komi and is subject to promulgation within seven days.
The law that has not been rejected by the Head of the Republic of Komi within fourteen days will also be subject to signing and promulgation.
The laws of the Republic of Komi will come into effect after their formal publication. The laws of the Republic of Komi and other legal acts of the Republic of Komi on protection of human and citizens' rights and freedoms will come into effect not earlier than ten days since their formal publication.
Article 77. Constitution of the Republic of Komi.
Within his term of office, a deputy of the State Council of the Republic of Komi will undertake to observe the limitations related to his activity as a deputy as provided by the federal legislation.
A deputy of the State Council of the Republic of Komi who exercises his powers on the standing professional basis will have no right to engage in any gainful occupation other than teaching, scientific or other creative activity, unless otherwise provided by the legislation of the Russian Federation.
A deputy will have no right to use his status for any activity that is not related to his deputy authority.
A deputy of the State Council of the Republic of Komi will be provided conditions to exercise his rights or responsibility efficiently and without hindrance. The guarantees for his deputy activity are provided by the Komi legislation.
The safe conducts of a deputy of the State Council of the Republic of Komi is determined by the federal legislation.
A deputy of the State Council of the Republic of Komi may be recalled by his voters.
The issues related to the activity and recall of the deputies of the State Council of the Republic of Komi will be dealt in accordance with the Komi legislation.
Article 78, Constitution of the Republic of Komi.
The State Council of the Republic of Komi may cease exercising its powers earlier in case:
1) the State Council adopts a resolution of voluntary dissolution;
2) the Head of the Republic of Komi dissolves the State Council on the grounds and order established by parts two and three of this article in accordance with the federal legislation;
3) the Supreme Court of the Republic of Komi takes a legal decision of ineligibility of that State Council deputy corps including the abdication case;
4) the President of the Russian Federation dissolves the State Council of the Republic of Komi on his decision on the grounds and order established by the federal legislation.
The Head of the Republic of Komi has the right to decide on early termination of the authority of the State Council of the Republic of Komi in case:
1) the State Council of the Republic of Komi approves the Constitution of the Republic of Komi, a law of the Republic of Komi or other regulatory legal act to be contradictory to the Constitution of the Russian Federation and the federal laws passed on the joint areas of responsibility of the Russian Federation and the subjects of the Russian Federation, the Constitution of the Republic of Komi if those contradictions have been determined by the court of appropriate jurisdiction and if the State Council of the Republic of Komi has not adjusted the differences six months since the date of the judicial act;
2) the effective judicial act of an appropriate court determines that the quorum of the State Council of the Republic of Komi has not held a session for three months in a row or if the effective judicial act of an appropriate court determines that the re-elected quorum of the State Council of the Republic of Komi has not been held a session for three months since the date of election. The resolution of early termination of the authority of the State Council of the Republic of Komi may be passed three months since the date of effective judgment.
The resolution of the Head of the Republic of Komi on early termination of the authority of the State Council of the Republic of Komi will be passed as a decree.
In case the State Council of the Republic of Komi ceases exercising its authority early, off-year elections of the State Council of the Republic of Komi are called in accordance with the federal legislation, the Constitution of the Re[public of Komi and/or the law of the Republic of Komi. The said elections will be held within the dates established by the federal legislation.
